What is Fair Dealing?

Permission is not required for copying that is Fair Dealing.  Fair Dealing is a user's right in the Copyright Act (sections 29, 29.1 and 29.2) meaning that copyright is not infringed when a "short excerpt" of a work is used for private study, research, criticism, review or newspaper summary.  The work may be used without permission or payment of royalties. To qualify, two tests must be passed:

  • the dealing must be for an allowable purpose
  • the dealing must be fair

The Association of Canadian Community Colleges has developed a Fair Dealing policy to be followed by community colleges in Canada.
